Regarding the removal of the 28 judges from the system due to a lack of moral integrity, Prime Minister Ariel Henry is consulting with advisers within the CSPJ, who remain uncompromising. "In terms of certification, there is no recourse. The legislator has decided so. The Council cannot fill the silence of the legislator, nor entertain recourse measures in the absence of a procedure provided by law," wrote the CSPJ in a memorandum dated June 1, of which the newspaper obtained a copy. "No jurisdiction can be established except under the authority of the law," the CSPJ continued.

Regarding a memorandum that would grant uncertified judges the right to initiate a recourse, the Superior Council of the Judiciary (CSPJ) stated that they found no trace of a supposed memorandum dated November 20, 2014, regarding the certification process, in their archives.
