Several human rights organizations, including Nègès Mawon, Nou Pap Dòmi, the Platform of Haitian Human Rights Organizations (POHDH), and the National Network for the Defense of Human Rights (RNDDH), are vigorously challenging the decree of December 1, 2025, on the organization and functioning of the High Court of Justice. Adopted by the Council of Ministers and published in Le Moniteur on December 17, 2025, the text is deemed contrary to the principles of the rule of law, good governance, and the fight against impunity.
In a joint statement, these organizations recall the strategic role of the High Court of Justice, an exceptional jurisdiction provided for by the Constitution and tasked with trying senior state officials for crimes or serious offenses committed in the exercise of their duties. This institution is meant to guarantee the accountability of leaders, the primacy of the law, and the stability of the State. However, they argue, the contested decree distorts this mission and weakens accountability mechanisms.
