Attorney Patrick Laurent analyzed the Court of Appeal’s ruling in the CPT-BNC case. According to him, the decision does not constitute a "stay" of the investigation but rather a suspended delay. He explained that the court did not rule on the jurisdiction’s competence but instead put on hold the summons issued for the three implicated presidential advisors: Smith Augustin, Louis Gérald Gilles, and Emmanuel Vertilaire.
"The decision of the Port-au-Prince Court of Appeal in the case of the CPT members regarding the corruption case at the BNC acts as a 'stay' concerning the investigative judge’s summons. The Court of Appeal has not ruled on the jurisdiction’s competence," analyzed Patrick Laurent on the Panel Magik program on Tuesday, February 25, 2025. The lawyer pointed out that the summons could take effect again once the individuals in question no longer hold their status as presidential advisors.
