The Department of Homeland Security (DHS) has acknowledged the federal judge’s decision postponing the end of TPS to February 3, 2026, instead of September 2, 2025. The department, in “strong disagreement” with the judge’s decision, indicated that it is working to determine the next steps—offering, according to some, a few months of reprieve to Haitian TPS recipients. “After reviewing the country’s situation and consulting the relevant U.S. government agencies, Secretary of Homeland Security Kristi Noem determined that Haiti no longer meets the conditions for Temporary Protected Status (TPS). See ‘Termination of the Designation of Haiti for Temporary Protected Status,’ 90 Fed. Reg. 28760 (July 1, 2025).

Haiti’s TPS designation and the associated benefits were originally scheduled to end on September 2, 2025. However, on July 15, 2025, a single district judge of the United States District Court for the Eastern District of New York issued a ruling in the case Haitian Evangelical Clergy Ass'n v. Trump, No. 25-cv-1464, which effectively postpones the termination date to February 3, 2026,” reads a DHS alert.
