The Court of Appeal of Port-au-Prince, sitting in an extraordinary public hearing dedicated to urgent habeas corpus matters, ruled on the case of the former Minister of Planning and External Cooperation, Aviol Fleurant. In a decision rendered in the name of the law, the court declared the appeal formally admissible but dismissed it on its merits, thus confirming the ruling issued on May 30, 2025, by the Chief Judge of the Court of First Instance of Port-au-Prince, Me Bernard St-Vil, which had rejected the habeas corpus petition filed by Me Fleurant.

The court’s decision is based in particular on Articles 363 and 384 of the Code of Criminal Procedure (CIC). The judges further held that the petition for legitimate suspicion filed before the Court of Cassation does not suspend the ongoing investigation. Consequently, the investigating judge handling the case, Loubens Élysée, remains competent until the highest judicial body of the country rules otherwise.
