The Department of Homeland Security (DHS) announced last Wednesday the end of Temporary Protected Status (TPS) for Haitian nationals as of February 3, 2026. The announcement follows a series of actions undertaken by the U.S. administration to suspend this temporary protection program for several countries, including Haiti. Faced with the wave of concern sparked by this decision among Haitian nationals benefiting from the status, attorney Frandley Denis Julien offers some explanations.
According to the immigration lawyer, there are several ways for various categories of migrants to adjust their status before February 3, 2026. This includes the U.S.-born children of migrants under the age of 21, foreign nationals married to a U.S. citizen, and parents of U.S.-citizen children. “These three categories, even if they have been in the country without legal documents for years, can adjust their status,” explains Mr. Julien. The possibility also extends to those who have already applied for a green card to reside in the United States.
