To give a semblance of constitutional basis to the political agreement signed between them, the stakeholders in the establishment of the Presidential Council repealed the Creole version of the Constitution that had not been amended. "Considering that the Constitution of 1987, as amended by the constitutional law of May 9, 2011, prohibits any recourse to the Court of Cassation to fill vacancies in the presidency duly established; Considering that the constitutional law of May 9, 2011, which has already had legal effects on the entire national life, repealed the Creole version of the 1987 constitution."
Then, the stakeholders in the establishment of the Presidential Council removed point 6) of Article 135 of the Constitution. Thus, to be President of the Republic (a member of the Presidential Council), the individual no longer needs to "have obtained discharge for the management of public funds if they have been accountable for public funds." It has been replaced by "undertakes not to be a candidate in the next elections."
