Slowly and with great difficulty, the members of the Presidential Council are beginning to give their own legal framework to the transition. The latest official decisions by the PTC are the appointment of Garry Conille by decree and the publication of the decree on the organization and functioning of the PTC in Le Moniteur. This decree emphasizes that it maintains the provisions of Article 5 of the decree establishing the PTC published by former Prime Minister Ariel Henry.

Article 5 of the decree of April 12, 2024, specifies that "The Presidential Transition Council: 1) participates, in agreement with the Prime Minister, in the formation of an inclusive ministerial cabinet; 2) approves the agenda of the Council of Ministers, in agreement with the Prime Minister, and co-signs the orders and decrees; 3) establishes the criteria for the selection of members of an impartial Provisional Electoral Council (PEC) and appoints them; 4) takes all measures favoring a peaceful transition; 5) ensures the continuity of governance and establishes a National Security Council; 6) continues collaboration with all members of the International Community for the accelerated deployment of the Multinational Security Support Mission (MSSM)  authorized by UN Security Council Resolution 2699/2023."
