While CPT member Louis Gérald Gilles is summoned to the investigative chamber on December 9 to answer questions from Judge Benjamin Félismé—who indicted him in the BNC corruption case— Gilles, through his lawyers, has challenged all the investigative chambers of the Port-au-Prince court. The lawyers assert that their client harbors suspicions against all the judges of the capital’s court.
"This legitimate suspicion is justified for the following reasons: considering that following the transmission to the prosecution of the October 2, 2024, report from the Anti-Corruption Unit (ULCC) related to the so-called 'BNC affair,' in which the name of the petitioner, a Presidential Transition Councilor, as well as two of his peers, was inappropriately mentioned, the case was referred to the investigative chamber and assigned to Judge Benjamin Félismé for investigation. Considering that after reviewing the case, the investigative judge, acting in accordance with the law and legal principles, is required to verify the status of the individuals involved before taking any investigative action," the lawyers for Louis Gérald Gilles wrote.
